These Terms of Use (“Terms”) govern access to and use of Nogative’s website, AI phone, call management, transcription, analytics, and CRM services.
1. Acceptance
By using Nogative, requesting a demo, creating an account, or accessing the service, you agree to these Terms. If you use Nogative for a business, you represent that you have authority to bind that business.
2. Service Description
Nogative provides AI-assisted phone handling, call forwarding workflows, call recording, transcription, summaries, CRM records, appointment support, analytics, and related automation. Calls are answered only according to forwarding or routing rules selected by the business customer, such as busy, unanswered, after-hours, or other configured conditions.
3. Customer Responsibilities
- You are responsible for the accuracy, legality, and configuration of your call flows, scripts, prompts, CRM data, and forwarding rules.
- You must provide any legally required notices and obtain any legally required consents for call recording, monitoring, transcription, AI interaction, SMS, email, marketing, and data processing.
- You must not use Nogative to impersonate people, deceive callers, make unlawful robocalls, send unlawful marketing, collect sensitive data without proper authority, or violate privacy, telemarketing, consumer protection, or recording laws.
- You are responsible for reviewing AI outputs before relying on them for important decisions.
4. Call Recording, AI, and Transcripts
Nogative may record calls, generate transcripts, summarize calls, analyze customer intent, produce lead scores, and update CRM records using AI. You authorize Nogative to process call and customer information as needed to provide the service. AI outputs may be incomplete, inaccurate, or delayed and should not be treated as professional advice.
You are responsible for playing or otherwise providing clear notices before or during calls where required. Some U.S. states require all-party consent for recording or monitoring calls, and rules may differ for phone calls, electronic communications, in-person conversations, healthcare, financial services, and other regulated contexts.
If you use Nogative for outbound calls, marketing, SMS, email, or AI-generated voice communications, you are responsible for obtaining any required prior consent, honoring opt-outs, and complying with TCPA, CAN-SPAM, state telemarketing laws, state privacy laws, and industry-specific rules.
5. Communications
By submitting a demo form or contacting us, you authorize Nogative to respond using the contact details you provide. You are responsible for ensuring that any outbound calls, texts, or emails you send through or in connection with Nogative comply with applicable laws and consent requirements.
6. Accounts and Security
You are responsible for keeping login credentials confidential and for activity under your account. Notify us promptly if you suspect unauthorized access.
7. Acceptable Use
You may not misuse the service, attempt to reverse engineer it, interfere with its operation, access it unlawfully, upload malicious code, violate third-party rights, or use it for fraud, harassment, unlawful surveillance, or unlawful communications.
8. Third-Party Services
Nogative may integrate with third-party communications, hosting, AI, analytics, form, CRM, and infrastructure providers. Your use of those services may be subject to their own terms and policies.
9. Intellectual Property
Nogative and its website, software, workflows, designs, branding, and related materials are owned by Nogative or its licensors. You retain rights to your business data, subject to the permissions needed for Nogative to provide and improve the service.
10. Disclaimers
The service is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free transcripts, perfect AI responses, or any specific business result, revenue recovery, conversion rate, or appointment outcome.
11. Limitation of Liability
To the maximum extent permitted by law, Nogative will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from use of the service.
12. Termination
We may suspend or terminate access if you violate these Terms, create risk, fail to pay applicable fees, or use the service unlawfully.
13. Changes
We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
14. State-Specific and Regulated Use
Nogative is designed for U.S. businesses, but state laws vary. California and other states may impose additional privacy notices, consumer rights, call recording consent, and disclosure requirements. Businesses in healthcare, legal, finance, insurance, education, or other regulated industries are responsible for confirming that their use of Nogative complies with applicable sector-specific obligations before processing sensitive information.
